PREVAILING WAGE ACT
The
Illinois Department of Agriculture (IDOA) has informed the Adams County Soil
and Water District that recent amendments to the Illinois Prevailing Wage Act
(PWA) clarified that ‘public works’ includes all projects funded in whole or in
part through bonds, grants, loans, or other funds made available by or through
the State or any of its political subdivisions (public bodies). The Illinois Department of Labor (IDOL) has
determined this definition to include soil and water conservation projects
funded through IDOA. As a result, such
‘public works’ projects would be subject to the provisions of the PWA.
The Prevailing Wage Act requires contractors and subcontractors to pay laborers,
workers and mechanics employed on PUBLIC WORKS construction projects no less
than the general prevailing rate of wages (consisting of hourly cash wages plus
fringe benefits) for work of a similar character in the county where the work
is performed.
ACSWCD responsibility is
to bring this to the attention of any individual (landowner) and or entity that
will receive public funds.
Failure to comply to
these new regulations puts the landowner and the contractor at risk of exposure
to later repayment of the difference between the wages actually paid and those
required under the PWA, as well as any applicable penalties (interest and
fines) should the issue be timely raised and a determination by IDOL confirms
the statutory requirement for a given project.
